Welcome to Lush Farms. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile application, and related services ("Platform") offered by Lush Farms ("we," "us," or "our"). By placing an order or using our Platform, you agree to be bound by these Terms.

1. Product & Service Availability

All products listed on the Lush Farms platform are subject to availability. We reserve the right to modify or discontinue any product without prior notice. Product images are for illustrative purposes only—actual product appearance may vary.
Products are guaranteed fresh and preservative-free. Customers must inspect goods at delivery; post-delivery complaints require proof.

2. Order Acceptance & Pricing

  • Orders are accepted only after confirmation via app, SMS, or email.

  • Prices listed are inclusive of applicable taxes unless specified otherwise.

  • In case of pricing or product errors, we reserve the right to cancel the order and issue a full refund.

 

3. Delivery Policy

  • Deliveries are made as per the slots selected during checkout.

  • Delivery timelines may be affected by external factors. For full details, refer to our Shipping Policy.

  • Customers must be present or provide clear instructions for contactless delivery to avoid failed deliveries.

  • Delivery personnel will attempt contact twice; failure to receive orders may result in no refund. Delivery windows may vary slightly due to traffic or operational delays.

 

4. Subscription Terms

  • Users can opt for recurring delivery via subscriptions.

  • Subscriptions can be modified, paused, or canceled through the user dashboard.

  • Charges will be applied as per the selected frequency and duration. Missed deliveries due to user error are non-refundable.

  • Minimum subscription duration may apply (e.g., 7 days).
    Customers manage subscriptions via the app/website (pauses, skips, or cancellations).

 

5. Returns & Refunds

Due to the perishable nature of our products, returns are not accepted. Refund or replacement requests must be made within 5 hours of delivery. For full policy details, refer to our Returns & Refund Policy.

 

6. User Responsibilities

  • Users are responsible for maintaining the confidentiality of their account and credentials.

  • You agree not to misuse the platform, violate any applicable laws, or engage in fraudulent activities.

 

7. Intellectual Property

All content on the Lush Farms platform—including logos, designs, images, and text—is the exclusive property of Lush Farms and protected under applicable copyright and trademark laws. Any unauthorized use or reproduction is strictly prohibited.

 

8. Limitation of Liability

Lush Farms shall not be liable for any indirect, incidental, or consequential damages arising from:

  • Delays or failure in delivery

  • Use or misuse of the products

  • Technical failures or platform downtime

  • We are not liable for allergies or misuse of products.

Our liability, if any, shall be limited to product replacement for verified quality issues.

 

9. Force Majeure

We are not liable for any failure to perform due to events beyond our control, including but not limited to natural disasters, strikes, transport interruptions, pandemics, or government actions.

 

10. Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

 

11. Amendments

We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the platform after changes constitutes your acceptance of the revised Terms.
